Maui County, Hawaii

Maui County is comprised of five islands in totality and has a population of 164,765. It is Hawaii's second-largest county with regards to total area, covering 1,161.5 square miles. The county seat of Maui County is Wailuku. The Maui County court system is unified, and part of the Second Circuit Court of Hawaii. It consists of a Circuit Court, a Family Court, and a District Court.

The Maui County Circuit Court, which is located in Wailuku, has jurisdiction over probate, criminal felony, and all civil proceedings. It handles civil actions in which the amount in dispute exceeds $40,000 and sees approximately 7,000 cases per year. The District Court has courthouses in four cities including Wailuku, Lahaina, Lanai, and Hana. This court is responsible for hearing civil actions with a claimed amount or damages of no more than $40,000, small claims cases of $5,000 or less, traffic infractions and violations, summary procession actions, and criminal cases with a maximum imprisonment penalty of a year. The Family Court has major jurisdiction in domestic relations cases and other legal matters involving children. This court presides over cases involving delinquency, adoption, domestic violence, parentage, termination of parental rights, status offenses, and child abuse.

The rate of violent crimes increased in Maui County from 2014 to 2022. In 2022, the county reported 293 violent crime incidents per 100,000 people. According to the Judiciary's 2023 Annual Report Statistical Supplement, the district court handled 87,755 cases, including traffic and parking cases. The family court oversaw and handled 8,966 cases between fiscal years 2022 and 2023. Maui County court records are kept and maintained by the clerks of the court where the cases were filed. The public has access to court records by using designated computers at the courthouses, public libraries, or remotely through eCourt Kokua. Although court records are open for copying and public inspection, records that relate to adoption, mental health commitment, and juvenile cases are considered confidential and can only be inspected with a court order or special permission.

Maui County courts are under a single administrative system, but each court has its area of specialization. Both circuit and district courts handle criminal and civil cases but to varying degrees. The Family court handles cases involving minors and family law. The court system provides remote and personal access to Maui Court records that are open to the public.
