Lexington County was created in 1785 in South Carolina. It is the sixth most populous county in South Carolina, with more than 295,934 residents as of 2022. The county occupies approximately 700 square miles of land in its home state. The Town of Lexington is the county's largest community and government seat. Lexington County has five Trial Courts: Circuit, Probate, Family, Municipal, and Magistrates Courts.

The Circuit Court in Lexington County has original jurisdiction over all legal matters beyond lower courts. It has two Divisions: the Court of Common Pleas and the Court of General Sessions. The General Sessions Court presides over misdemeanor and felony trials, while the Common Pleas Division handles civil lawsuits. About / Additional Info: The Circuit Court is the state's court of general jurisdiction. It has a civil court, the Court of Common Pleas, and a criminal court, the Court of General Sessions. In addition to its general trial jurisdiction, the Circuit Court has limited appellate jurisdiction over appeals from the Probate Court, Magistrate's Court, and Municipal Court.The State is divided into sixteen judicial circuits. About / Additional Info: The Magistrate Court is the Summary Criminal Court and the Small Claims Court for South Carolina residents. It is established under the SC Unified Judicial System supervised by the Chief Justice of the SC Supreme Court through the Office of Court Administration.The Magistrate Court is responsible for trying all traffic cases and misdemeanor criminal offenses that carry up to a 30-day jail sentence or $500 fine plus assessments. Criminal cases that have more severe consequences are referred to the General Sessions Court.The Magistrate Court also handles small claims disputes up to $7,500 in value and landlord-tenant disputes.
