Montgomery County, Ohio
Montgomery County is the fifth most populous county in Ohio and is located in the southwestern region of the state. It was established on May 1, 1803, and its county seat is Dayton. Montgomery County's population is estimated at 536,121 as of 2022. Diverse cases are handled and settled by the Courts of Common Pleas, Municipal Courts, and Mayor's Courts, providing answers to the community's legal needs by resolving cases with skill and competence.
The Court of Common Pleas has one probate division, a general division, one domestic relations division, and two juvenile divisions. The Courts of Common Pleas are located in Dayton, except for the satellite juvenile court located in Centreville. One of the juvenile divisions is the satellite juvenile court of Washington Township, the City of Kettering, and the City of Centerville and it presides over these jurisdictions. The Courts of Common Pleas handle death penalty matters, business disputes, and medical malpractice cases. The probate division deals with estate administrations, adoptions, trusts, guardianship, mental health cases, and the issuing of birth certificates and birth certificate corrections. Offenders under the age of 18 years who commit crimes are handled in the juvenile division. Likewise, if a juvenile commits a serious offense they face a penalty in the adult court. The Dayton Municipal Court (Dayton), Kettering Municipal Court (Kettering), Miamisburg Municipal Court (Miamisburg), Oakwood Municipal Court (Oakwood), Vandalia Municipal Court (Vandalia), Montgomery County Municipal Court Western Division (Trotwood), and Montgomery County Municipal Court Eastern division in Huber Heights are courts of limited jurisdiction handling adult traffic, misdemeanors, and most general civil claims in which the amount in dispute is $15,000 or less. The Mayor's Courts have jurisdiction over some criminal and quasi-criminal matters in territories not within the jurisdiction of Municipal Courts. From the 2022 annual Montgomery County Municipal Court caseload report, in the (western division) 38,880 cases were treated in the calendar year 2022, these included new cases (15, 988), cases transferred in, and pending cases). A total of 36,144 cases were terminated that year. For the Eastern division, 6,106 cases were filed and 5,378 terminated. The Montgomery County Clerk of Courts properly files and stores court records permanently. The clerk is responsible for indexing, preserving, and certifying court records. A member of the public is at the disposal of court records of interest by visiting the clerk's office or website or at the mayor's and municipal courthouses. Adoption files/proceedings and probate/parole records are unavailable for public inspection.
The Courts of Common Pleas, Municipal Courts, and Mayor's Courts are courts of law dedicated to the task of upholding the Constitution and administering the law in a just and equal manner. Furthermore, the clerks of each court have in no small way contributed to facilitating the process of making court records obtainable to the general public giving room for scrutiny in the county's court system.
