Clay County's legal history runs back to 1828 when it became the first county in Missouri to order the execution of a female slave for the murder of five children. Since that time, Clay County's court system has developed more effective measures for delivering justice and maintaining order in the county. Presently, the county has one Circuit Court and fifteen Municipal Courts to serve its 253,085 residents. Though charged with the same aim, each court exercises distinct jurisdictions over different legal issues.

The Clay County Circuit Court is responsible for ensuring that all civil and criminal cases are handled efficiently. It is classified into nine Divisions based on the type of cases. These Divisions are named Divisions 1 to 9, however, they fall under the following categories: the Associate Circuit, Family Court, Juvenile Court, Probate Court, Small Claims Court, and Traffic Court. The Associate Circuit handles misdemeanors and infractions. As the name implies, the Family Court has exclusive jurisdiction over all family cases including divorce, child support, and child protection. The Juvenile Court handles all juvenile cases, while the Probate Court handles all probate matters. Most civil claims are heard in the Small Claims Court, while the Traffic Court handles all cases involving violation of traffic ordinances. With the Circuit Court handling most legal issues (3000 cases annually), the Municipal Courts focus on handling violations of municipal ordinances. The Circuit Court and most Municipal Courts are located in the city of Liberty, which holds the county seat.
