With over 268,567 residents, Cherokee County is the sixth largest county in the Atlanta metropolitan area. It is also a noteworthy tourist destination, thanks to its rich history. When legal matters arise, they are handled by the well-equipped court system which consists of the Cherokee County Superior Court, the State Court of Cherokee County, Cherokee County Juvenile Court, the Probate Court of Cherokee County, Cherokee County Magistrate Court, Municipal Courts, and Recorder's Court. Each court makes distinct legal contributions to the administration of justice in the county.

The Superior Court has jurisdiction over felonies, real property cases, family law cases, and other civil and criminal cases that are beyond the jurisdiction of other courts. The State Court, on the other hand, handles misdemeanors, traffic offenses, and civil cases that are not within the exclusive jurisdiction of the Superior Court. Per the name, the Juvenile Court has exclusive jurisdiction over cases involving children alleged to be delinquent. The Probate Court also has exclusive jurisdiction over probate matters including estate administration and conservatorships. The Municipal Courts share jurisdiction with the Magistrate Court over some cases. Both courts handle minor criminal offenses and preliminary hearings before cases are transferred to the Superior Court for jury trials. However, the Magistrate Court is responsible for handling county law violations, while the Municipal Courts handle municipal law violations. Other county law violations are handled by The Recorder's Court. It also has jurisdiction over traffic infractions. All Cherokee Courts, except the Municipal Courts, are located in the city of Canton.

In the place where the metro meets the mountains, police departments record up to 6.91 crimes per 1000 residents annually. This accounts for the 1,953 cases that are heard in its courts annually. Cherokee court records are maintained by the Clerk of the Superior, State, and Magistrate Court, and they can be reviewed by members of the public. To do this, one can approach the Clerk in person or use the Online Docket Feature. Notably, the Clerk will not release information on an ongoing investigation or personal information of parties involved in a case as they are exempted from public disclosure but can assist on how to go about doing so. Records that contain sensitive information such as juvenile, custodial, medical, mental health, and personal identifying information matters will be confidential and sealed, requiring special permission.

Parking: Parking areas are located behind both the Justice Center and the Historic Marble Courthouse. The City of Canton issues parking citations for certain spaces located on the street. The courthouse is very busy and parking is limited, so you may want to arrive a few minutes early to ensure a parking space. The map below shows available off-street parking locations.
Directions: If you are traveling north on I-575, use exit 19B (Downtown Canton). At the end of the exit ramp you will turn right and travel 1.7 miles (you will pass the Darby Funeral Home). Stay to your right, and the Justice Center will soon be on your right. You may park directly behind the Justice Center or you may cross through the parking lot to the Historic Marble Courthouse and park behind it.If you are traveling south on I-575, use exit 19. Public transportation: Cherokee Area Transportation System (CATS) provides public transportation service for residents of Cherokee County.
Restrictions: You may NOT bring any type of gun (hand gun or rifle), potential weapon or explosive material, knives, forks, pepper spray, mace, aerosols, scissors, knitting needles, or any sharp pointed item. Do not bring anything of value that you cannot keep under your control as you move about the courthouse.

About / Additional Info: The Superior Court of the Blue Ridge Judicial Circuit is created by the Constitution of the State of Georgia. Cherokee County is the only county in the circuit. Superior Court is the general jurisdiction court, with authority to hear all civil and criminal cases. It has exclusive jurisdiction over felony criminal cases, divorces, cases in equity and cases involving title to land.
