Miller County, Arkansas
Following an abolishment in 1838, Miller County was recreated from a portion of Lafayette County in 1874 and encompasses a land area of 624.0 square miles. Texarkana serves as the county seat, and as of the 2022 census, the population was 42,600. The Miller County court system comprises two main parts: circuit court and district court. These courts oversee various legal matters within the county.
The Miller County Circuit Court, located in Texarkana, functions as a trial court with general jurisdiction, overseeing criminal, civil, probate, juvenile, and domestic violence cases. With its three divisions, it has the statutory authority to handle all civil cases above $100 and criminal cases involving misdemeanors, felonies, and lesser-included offenses. Additionally, the Miller County District Court, also located in Texarkana, holds limited jurisdiction over certain types of criminal and civil cases. This court conducts preliminary hearings for all criminal cases, adjudicates civil claims of up to $100, traffic cases, and local ordinance violations.
Miller County has witnessed fluctuations in the number of reported crimes over the years. A total of 3911 crimes were reported in 2020, 3866 in 2021, and 3868 in 2022. While offenses such as vandalism, simple assault, aggravated assault, and intimidation showed a consistent increase over the three years, there was a significant decrease in drug/narcotic violations. The Miller County Circuit Clerk maintains up-to-date court records of cases filed within the county. Upon request, interested parties can access publicly available court records either by visiting the clerk's office or using the Search ARCourts portal. It is worth noting that the public cannot inspect sealed or expunged court records, including the following:
- Tax records
- Adoption records
- Deliberative materials regarding decisions of the jury, judge, or court staff
Special permission or court order must be obtained to access these types of records because they are sealed from public viewing due to sensitive case information.
In summary, the Miller County court system is an essential part of the county government that handles all legal affairs. It consists of a general jurisdiction court (circuit) and a limited jurisdiction court (district). Handling a broad range of cases varying from criminal, civil, probate, juvenile, domestic violence to traffic infractions, misdemeanors, felony cases, and local ordinance violations, Miller County continues to do due diligence to ensure the comfort and safety of its residents. Miller County court users can inspect publicly available court records from a remote location or at the clerk's office.
