The District Courts, Justice of the Peace Courts, Municipal Courts, and County Courts at Law make up the judicial system in Montgomery County.

Situated in Conroe, Texas, the eight Montgomery County District Courts have original jurisdiction in criminal and civil matters and may also handle probate, juvenile, and family law matters. Equally located in Conroe, the five County Courts at Law handle Class A and B misdemeanor offenses and appellate cases from the Justice of Peace Courts and Municipal Courts. The Montgomery County Justice of the Peace Courts hold hearings for minor civil cases such as small claims, evictions, and debt collection cases. They also hear Class C misdemeanors, including petty theft, public intoxication, disorderly conduct, and traffic violations. Within their boundaries, municipal courts preside over cases involving the ownership of dangerous dogs, class C misdemeanor criminal offenses in which the punishment is a small fine, and the violation of city ordinances. Municipal Courts are located in Montgomery, Splendora, Stagecoach, Magnolia, Cut and Shoot, Oak Ridge North, Conroe, Panorama Village, Patton Village, Roman Forest, Woodbranch, Shenandoah, and Willis.

The District Clerk and County Clerk are the custodians of court records in Montgomery County. The District Clerk's Office maintains civil, family, and felony records. To access records, the public can use the District Clerk Court Records Inquiry platform or request copies from the Records Research Department through mail or in person. Furthermore, the County Clerk maintains civil, probate, and misdemeanor court records for the County Courts at Law. These records are accessible on the County Clerk Court Records Inquiry platform. In addition to keeping records, both the district and county clerks publish monthly reports on the caseloads of county and district courts. In a year, County Courts at Law handle approximately 2,000 family law, 600 civil, and 3,000 criminal (excluding misdemeanors) case dispositions. On the other hand, District Courts handle approximately 8,000 criminal, 6,000 civil, 6,000 family law, and 400 juvenile case dispositions in a year.
