Muskogee County, Oklahoma
Muskogee County was founded in 1907 and named after the Muscogee River. It was formerly named Muscogee but was changed to Muskogee by the post office in 1900. The population as of the 2022 census was 66,606 and the county seat is the City of Muskogee. Muskogee County belongs to Judicial District 15. The county and city were named for the Muscogee (Creek) Nation. The Municipal Courts and a District Court interpret the law, uphold the rule of law, and encourage equity in discharging their legal duties to the Muskogee County community.
The Municipal Courts are in eight locations across Muskogee County. Boynton Municipal Court, Porum Municipal Court, Webbers Falls Municipal Court, Warner Municipal Court, Muskogee Municipal Court, Haskell Municipal Court, Fort Gibson Municipal Court, and Braggs Municipal Court serve the over 60,000 residents in Muskogee County by hearing traffic violation cases, building code violation cases, and cases resulting in municipal ordinance violation. The District Court has broad jurisdiction over many cases. It conducts jury trials and has five subdivisions handling serious offenses. Some of the cases that the civil, family, traffic, criminal, and domestic violence courts/divisions handle are settlement of disputes, child custody, reckless driving, misdemeanor, and spouse harassment cases respectively.
In the 2022 annual report of the indigent defense system of Oklahoma, the District Court caseload was published for cases such as felony, traffic, and juvenile delinquency cases. 51,872 cases were filed in fiscal year 2022, in addition, there was an 8% decrease in the number of filed cases compared with fiscal year 2021. Between fiscal year 2020 and 2022 non-capital trial felony cases reduced, which led to the drop in the number of caseloads in Oklahoma up till 2022. In the General Appeals Division (non-capital general appeals), 488 cases were treated for the fiscal year 2022 (new cases in 2022 and pending cases from 2021), the division closed 244 cases and transferred the remaining 244 cases to the 2023 fiscal year. The Muskogee County Court Clerk (for District Court) and Municipal Court Clerks are tasked with the responsibility of approving public court record requests, filing, and maintaining court records in the county. On the contrary, juvenile court records and court-appointed special advocate records pertaining to a child welfare case are not to be viewed or inspected by the public except if permission is granted by court order or for judicial review.
The District and Municipal Courts have over the years developed adherence to professionalism in performing their constitutional duties. This has put in place a system that gives valuable insight into all court cases thereby giving rise to law-abiding residents.
